Discovery: The legal process of discovering information related to a lawsuit.
Discovery: Discovery refers to the legal process whereby each party (plaintiff and defendant) to a lawsuit can formally "discover" information about the case or about the other party. Each party will attempt to discover information relevant to their pursuit of the lawsuit from the other party. Discovery may involve depositions, written interrogatories, requests for documents, requests for admissions, demands for medical examinations, and other legal procedures. In some cases, a party can be compelled to hand over information that they wished to keep confidential. In some cases, certain information or documents may be protected from discovery by privilege. There are numerous other limitations that may restrict what can be discovered, so that not all information and documents can be received or compelled in discovery. There are also a large number of legal procedures to be followed as part of the discovery process. Discovery can also occur as part of arbitration or other legal proceedings. Discovery is a complex area of law and requires professional legal advice.
