A mother and her obstetrician negotiated an adequate birthing plan for her second baby after her first baby had shoulder dystocia. The plan relied on the midwife and obstetrician both being present for the birth. During the birth, only the midwife was present to deal with the shoulder dystocia that occurred. As a result the midwife used inadequate techniques to deliver the baby who had a limp arm after delivery. As a result $3 million was awarded against the obstetrician and midwife.
