Victory reversed after inadmissible evidence used in medical malpractice suit



In a medical malpractice case, a high court reversed a plaintiff’s victory due to the improper admittance of a testimony by an expert witness. The witness provided information relating to tumour growth rate and hence inception of the cancer. Thus, possibly inaccurate information was used when the plaintiff’s case stated that the defendant’s negligence resulted in a delay in diagnosis and treatment of cervical cancer which resulted in a reduced chance of recovery.
